V.  THE COMMISSION FAILED TO PROCEED
IN THE MANNER REQUIRED BY LAW.

A.    THE COMMISSION MISCONSTRUED THE
LAW.

The Administrative Law Judge in this proceeding
explained how the COMMISSION would fulfill its
responsibility to weigh the evidence:
“… you
know, who’s right or wrong and cunning
and lying at the swimming pool, I don’t think
that’s going to require more than a couple
of minutes of discussion”
(page 794 of the
Court Reporter’s transcript).  

This is how the COMMISSION reached its
stunning conclusion that Petitioner did not
have a hostile work environment and that
the District had behaved reasonably.

The number of Findings of Fact in this case
which fly in the face of undisputed
evidence is mind-boggling.  
“… You know, who’s right or wrong and
cunning and lying at the swimming pool, I
don’t think that’s going to require more than
a couple of minutes of discussion”
The three
members of the
COMMISSION
have signed their
names to a
compendium of
Findings and
Legal Conclusions
which is
staggering in its
self-contradictions
and outright
falsehoods.  
This is how the
COMMISSION
reached its
stunning
conclusion that
Petitioner did not
have a hostile
work environment
and that the
District had
behaved
reasonably.
