Devaney carries insider baggage in city attorney
fight

In 1992, after seven years of working her way through
the San Diego City Attorney's Office, Leslie Devaney
decided it was time for a change.

To the shock of some of her colleagues, she took a
job as a senior litigator for insurance giant American
Insurance Group.
Four years later, following a lunch with the new city attorney,
Casey Gwinn, Devaney concluded it was time for a change.

She returned to the office she had left, this time to be Gwinn's
top assistant. Now, eight years after that lunch, Devaney is
attempting one more change: moving up from No. 2 in the
office to the top slot...

But in a year when City Hall has been rocked by revelations
about its debt-ridden pension fund and federal investigations
into financial disclosure practices, Devaney is faced with an
unusual challenge...

But at the same time, she has to fend off attacks from her
opponent, Mike Aguirre, a securities lawyer in private practice,
that she is part of the City Hall culture that is responsible for
the city's current predicament.

"Devaney's biggest problem is she is too associated with the
Gwinn faction," said Carl Luna, a political science professor at
Mesa College. "With all this bad news coming down, it makes
everyone in City Hall look bad."

Education: Bachelor's degree in political science from the
University of California San Diego; law degree from the
University of San Diego.

Experience: Executive assistant city attorney (on unpaid leave
for campaign); former deputy city attorney; senior litigator for
American Insurance Group.

Personal: Married to Frank Devaney; two daughters, Kaitlin, 16,
and Brenna, 14...

She is endorsed by Gwinn and a list of other organizations –
such as the
Lincoln Club, a Republican business group, and
the association representing state deputy attorneys general.
Devaney has raised $314,881 in cash for her campaign,
including a personal loan of $31,000.

Devaney, whose husband, Frank, is also a lawyer in the City
Attorney's Office [Frank Devaney was appointed to the San
Diego Superior Court soon after this article was published],

said she left the office in 1992 in large part because she felt
she was being shut out of the bigger, more interesting cases.
She had begun working there in 1985, concentrating on cases
of alleged police excessive force and dangerous road
conditions...

Recruited by AIG to establish a corporate office here, she
jumped at the chance. "It was a whole new world," she said.
"There is a whole other mentality in private practice – the
work ethic, other things. You always have to be constantly
learning."

But after four years, she got a call from Gwinn asking her to
lunch. He was about to succeed John Witt as city attorney and
wanted to discuss ideas he had for the office, she said.

At the end of the lunch, Gwinn offered her the job as second
in command.
"I thought it would be a great challenge," she
said of her decision to return. "And as the second in charge, I
could help shape it into what I thought the office could
become."

...Devaney bristles at Aguirre's efforts to hold her responsible
for a series of ills – from the pension debacle to the Chargers'
ticket guarantee and the $100 million verdict against the city in
the Roque de la Fuente II case. The huge verdict came in a
suit where de la Fuente said the actions of city officials
devalued an Otay Mesa business park he developed. She tells
audiences she expects Aguirre to next blame her for global
warming.

But the task of touting her experience in the office while
trying to distance herself from the office's controversial
actions is tricky
. "She is trying hard to present herself as a
capable administrator," Luna said. "The problem is, that does
not gibe with things not going very well lately."...

If she is elected, her husband would leave the City Attorney's
Office to avoid potential conflicts of interest, Devaney said. She
and her husband have two teenage daughters...

agreement released by the hospital's attorney late Monday afternoon.

After narrowly losing the November election for San Diego city attorney, Leslie Devaney just couldn't shake her interest in
municipal law.
"I had made all these contacts with a number of agencies in my campaign for city attorney, "says Devaney, who was the executive
assistant city attorney from 1995 until just this fall." I could probably go back into just litigating, but it seemed like the experience I
got from the campaign enhanced [my appeal]."
San Diego-based government relations specialty firm Stutz Artiano Shinoff & Holtz agreed; Devaney starts as a partner at that
firm's downtown San Diego office March 1,where she'll head the firm's government relations and municipal law practice group.
Devaney says she chose 26-attorney Stutz Artiano after putting out her credentials out to a variety of firms. Her plan was always to
leave the city for a private firm if she didn't win the election, she says.
And after helping smooth the transition for new San Diego Attorney Mike Aguirre, that's excatly what she did, despite the
opportunity to keep the same job under Aguirre.
At the firm, Devaney will represent government entities and advise private clients on how to interact with government agencies.
It's a big change from her last job, where she was second in command under former City Attorney Casey Gwinn, advising the
mayor, City Council and departments and taking over for Gwinn when he was away from the office.
Managing partner Ray Artiano of Stutz Artiano says Devaney's extensive experience with the city made her extremely attractive to
his firm, a business firm that specializes in representing public agencies and school districts.
"She's a perfect match for us,and...I'm sure she's going to be a great asset for the firm, "Artiano says. "Her years with the city
attorney's office, where she was involved with litgation and a host of other matters, gives her the depth of experience working with
municipalities that we were looking for."
In addition to it's San Diego office, Stutz Artiano has offices in Santa Ana, Temecula, Los Angeles and Las Vegas.
Maria Velasquez, a spokeswoman for the city attorney's office, says members of the office decline to comment on Devaney's
departure.
Gwinn, Devaney's former boss, says he has "nothing but great things to say about Leslie."
"Leslie is going to succeed wherever she goes," says Gwinn, now director of restitution enforcement and victim services for the
San Diego County district attorney's office. "She's always been great at building relationships with people,...I think her eight years
of experience in the public sector are only going to make her better in private law practice."

Devaney had some down time between jobs; she officially left the city the first week of February. She had put that time to
use, drumming up clients for her new practice who expressed interest in retaining her as a private attorney.

Devaney characterizes these potential clients as companies that do business with public entities, but she declines to name
them specifically.

She had also been able to take some time to devote to her family; her husband, Frank Devaney, was appointed a San Diego
Superior Court Judge on Jan.21.
He previously headed the trial unit of the civil section of the San Diego city attorney's office, a position Devaney says her husband
was planning to leave after the election regardless of its outcome.

"He gave two weeks' notice on Tuesday without knowing what he would do from there," she says. "Two weeks later, on a
Thursday, [he] got the call...[and] got sworn in the Wednesday following...

Governor Schwarzenegger Appoints Two
Judges to the San Diego County Superior Court

Governor Arnold Schwarzenegger today
announced the appointment of Francis “Frank”
M. Devaney and Timothy B. Taylor to judgeships
in the San Diego County Superior Court.

Devaney, 50, of San Diego, has served in the
San Diego City Attorney’s office for more than 21
years.
He began as a deputy city attorney in the Criminal
Division in 1983. He then moved to the Civil Litigation Division
where he handled defense of personal injury complaints, writs
and appeals. In 2001, Devaney became head deputy city
attorney in the Trial Unit of the Civil Division where he
managed the selection, training, supervision and mentoring of
25 deputy city attorneys. Devaney has also served as a
workshop leader for the San Diego Inn of Court trial practice
and evidence workshop programs since 1994 and currently
serves as a Master of the Enright Inn of Court.

Devaney earned a Juris Doctorate from Santa Clara University
School of Law and a Bachelor of Arts degree from Hobart
College. He is a member of the San Diego County Bar
Association and the California State Bar Association. He fills
the vacancy created by the retirement of Judge Vincent P.
DiFiglia. Devaney is registered decline-to-state...

The compensation for each position is $139,784.

I assume God very much appreciates your offer
of help.  That is, if He can't manage on his own.  
What exactly were you planning on helping Him
with?  I suspect God has big plans for this
newly-discovered black hole in a nearby
galaxy.  It has 6,400,000,000 times the weight of
the sun.  Obviously, this is an important
project, and we wouldn't want it to go wrong.  
But that's not what you were planning on
helping him with, is it?

You just want to help him with politics, right?  
This makes me wonder if you really mean
Arnold Schwartzenegger when you say "God."  

I was also wondering, when you helped with
the chad count in Florida in 2004, were you
helping God make history?  

As opposed to the voters of America?

A wise man once said, "Render to Caesar the
things that are Caesar's, and to God the things
that are God's."  That might be a good topic for
PWF's bible study.]

March is Women's History Month and a great
opportunity to look at the many accomplishments of
women. What kind of history are women making?
Are we as Christian women helping God make
history?

Mindy Tucker Fletcher is a former member of the
PWF Board of Directors. Now, as
Deputy Chief of
Staff for External Affairs, Mindy serves
Governor Schwarzenegger as his liaison to a
variety of constituencies,
coalitions and
organizations including employers and industry
groups, labor unions, education and transportation
coalitions, tribal and local governments and law
enforcement and public safety groups. She also
serves as the Governor’s liaison to the California
Republican Party as a member of its Board of
Directors...

Mindy has built a career in politics and public service
in Texas, Washington, D.C. and California. After
graduating from Southern Methodist University in
Dallas, Texas, Mindy spent six years in Washington,
D.C. where she served as Communications Director
for Congressman Sam Johnson and as the Deputy
Communications Director at the National Republican
Congressional Committee.
Mindy joined the team
of then Governor George W. Bush as the
spokesperson for this 1998 gubernatorial re-
election campaign in her home state of Texas.

In 1999, she became Press Secretary for the Bush-
Cheney 2000 effort, where she worked closely with
national and regional media, managed the day-to-
day operations of the communications division and
appeared regularly on national television and radio
programs.
During the Florida Recount she
served as the senior spokesperson for the
recount effort. After President Bush took office
in 2001, she became the first woman appointed
Director of Public Affairs at the United States
Department of Justice.
Mindy helped the
department through a year that included the Robert
Hanssen espionage case, the Timothy McVeigh
execution, the Microsoft settlement and the terrorist
attacks of September 11.

In January of 2002, she became the Party’s chief
spokesperson as Director of Communications for the
Republican National Committee before she moved to
San Diego in 2003.
During 2004 she was active
in the President’s re-election campaign s
erving
as a National Co-Chair for the W Stands for Women
effort and making regular television appearances.
Mindy returned to Florida for the final months
of the campaign where she assisted all of the
target states in dealing with the numerous
legal and ballots issues...

Mindy resides in San Diego with her husband
Nathan, a Marine Corps reservist, and although her
schedule doesn’t allow much free time, she operates
on the principle that a good baseball game can
always fit into your schedule.

back on track

Directors of the local Business
Improvement District, also known as
Promote La Jolla, managed to put
aside their differences last week
and focus on the
mundane-but-crucial task of helping
the Village commercial district stay
afloat during the recession.

Meeting Feb. 11 at the La Valencia
Hotel, the reconstituted board of
directors for Promote La Jolla held
a wide-ranging discussion on ways
to foster tourism as well as
patronage by local residents...

Last month, the board, which has
five newly elected members, was
unable to complete its annual
goal-setting session because of
dissension over a lawsuit Hotel
operator Bob Collins and bookstore
owner Nancy Warwick had filed
against the organization over the
2007 board election.

At this month's meeting, newly
installed board president Rick
Wildman, a local attorney,
announced that a final settlement
ending the lawsuit had been filed in
Superior Court.

'It's over'
"It's over," Wildman said. "There's
no need for any more closed
meetings" to discuss the litigation.

The termination of the lawsuit
seemed to end the tension
between board members. Also
noticeably absent from the
meeting was attorney Leslie
Devaney, who was hired by
former president Deborah
Marengo to coach the board on
how to comply with the Brown
Act, the state's open meetings
law for public agencies.

"Everyone is working together
now and it's fun," Wildman said
in an interview after the
meeting...

...When Aguirre was running for his current
post against former Assistant City Attorney
Leslie Devaney, Aguirre blasted her for
setting up a campaign fundraiser with Mike
Conger, an attorney who was suing the city
for underfunding the pension system.
Conger, of course, went on to collect
attorney fees after it was settled. Aguirre
was incensed: How could Devaney collect
money from someone so obviously
interested in an outcome from the City
Attorney's Office.

The U-T's Ray Huard wrote up a story:

Devaney said she would appoint a deputy
city attorney to oversee contracts with
outside lawyers rather than handling them
herself to avoid conflicts should campaign
contributors, such as Conger, have
business with the city.

Devaney's opponents questioned her
letting Conger host the fund- raiser.

"We have a billion-dollar deficit in the
pension plan," Aguirre said. "This is going
to be one of the most hotly contested legal
issues, and the attorney on the other side
is raising money for the attorney who's
supposed to be protecting the city."

I called Conger today to confirm. He said
that, yes, he had scheduled a fundraiser for
Devaney. He didn't know her well but knew
her husband, former Deputy City Attorney
Frank Devaney. He said they canceled the
fund raiser after the U-T story ran...

share of its cases, is closely tied to right-wing Republicans such as Lesley Devaney.  
Devaney joined the Stutz law firm after losing to Michael Aguirre in the race for San

Another response to "The Collateral
Damage of Aguirre's Furies"

Thank you Ms. Devaney for your opinion on
Mr. Aguirre's first year of being in office.
Now, if you don't mind, I'll ignore that
opinion. You see, it was your previous boss
Casey Gwinn, who went "ostrich" when the
excesses of City Council went unimpeded
and unchecked leading to our infamous
"Enron by the Sea" name tag. Weren't you
second in command, at the city attorney's
office, when all of this public profiteering
was in full swing?

San Diego needs a populist, activist city
attorney. I applaud Mr. Aguirre and Don
McGrath for "jumping into the fray." Does
the bungling of the De La Fuente judgments
ring any legal jingle bells? Would
Councilman Madaffer have been able to
orchestrate retroactive pension benefits for
past council members under Mike Aguirre's
tenure? The answers to these concerns are
publicly evident. Mr. Aguirre and his team of
transparent oriented city attorneys are
representing an under represented
constituency.

Ms. Devaney, that constituency would be
taxpaying citizens of San Diego. From taking
on the largess of SDCERS to the special
interest take over of the Torrey Pines Golf
Complex, Mr. Aguirre is on the right track.
Had Mr. Gwinn (with you at his side) not
been asleep during his watch, San Diego
would probably be in a better financial
position. Please ponder that if you need to
spend time ruefully worrying about the city's
current state of affairs.

I don't think I'm influential at all, but Leslie Devaney thinks I am.  

She's suing me for defamation for what I've written on this website.  I sure don't know how
she's going to prove that I interfered with her profits.  No TV station or newspaper in San
Diego will cover my story, even though my school,
Castle Park Elementary in Chula Vista,
continues its spectacular
descent into chaos.

I believe that the school (which I attended as a child) has become so dysfunctional that it
should be removed from the control of Chula Vista Elementary School District and the state
should take it over.

P.S.  During my deposition on June16, 2008 by Stutz lawyer  Ljubisa (
Luubisha) Kostic, I
was asked in particular about my Leslie Devaney column (right).  I got the impression that
one of the 20 most influential women in San Diego is angry at this unemployed
schoolteacher.  

The San Diego Union Tribune and Chula Vista Star-News might leave me out of their
reporting on Castle Park Elementary, but it's gratifying to know that Leslie Devaney thinks
I'm important.

...Aguirre's most explosive action last week was his beginning an independent investigation into allegations that city
employees lied and withheld information in disclosures related to its pension deficit.

Attorney Patrick Shea, a friend of Aguirre's and one of four unpaid advisers assessing staff changes in the City
Attorney's Office, called the step essential.  "There is going to be an unavoidable irritation" between Aguirre and
city officials "who don't want that kind of disclosure," Shea said.  "Mike has no choice but to do what he's doing," he
said. "Mike didn't create this situation. The reality is that the financial markets do not believe the materials . . .
published by the city of San Diego."

leave in March 2005.
Mike Aguirre, San Diego's new city attorney, is fighting City Hall from within it.  During his first week in office,
Aguirre criticized the city's leadership, revived a dormant public integrity unit with prosecution powers
and began an investigation into allegations of accounting fraud by city officials.  
"We will work to restore
government integrity," Aguirre said at his swearing-in ceremony Monday. "The City Attorney's Office will not remain
on the sidelines and watch San Diego slide deeper into the financial abyss."...

Aguirre said his top priority is erasing the stain of a city fiscal crisis marked by a billion-dollar pension deficit, two
overdue annual audits and a borrowing ability so crippled that new water and wastewater projects are on hold.  
The
city's finances are being investigated by the FBI, the U.S. Attorney's Office and the Securities and
Exchange Commission.

Aguirre said solving the crisis will require disclosing its extent, depths and breaking a chain of closed-door City
Council meetings about it.  "It just invites disrespect and concern when we're meeting in closed session talking about
criminal investigations of city officials," he said.

Devaney, 50, of San Diego, has served in the San Diego City Attorney’s office for more than 21 years. He began as a deputy city
attorney in the Criminal Division in 1983. He then moved to the Civil Litigation Division where he handled defense of personal injury
complaints, writs and appeals. In 2001, Devaney became head deputy city attorney in the Trial Unit of the Civil Division where he
managed the selection, training, supervision and mentoring of 25 deputy city attorneys. Devaney has also served as a workshop

The Collateral Damage of Aguirre's Furies

Well, it's been a long year at City Hall. City Attorney Mike Aguirre has
certainly shaken up city government and redefined the role of the city
attorney. His actions remind me of the quote from Shakespeare's
"Macbeth":
"Full of sound and fury, signifying
nothing."

Despite the numerous public discussions, debates and
frequently embarrassing displays about who is
right on the issue of the proper role of the city
attorney,
the fact remains that Aguirre has redefined the city
attorney position in a way not previously seen in San Diego or
anywhere else in the state.

Let's look closer at what has occurred in the Office of the City Attorney
since Aguirre was elected. Within one year, he has either dismissed
or driven out more than 50 staff members from his office, including
dozens of very experienced attorneys. The most common phrases I
hear from those who remain are, "I'm trying to get out," "I'm looking,"
or "I'm keeping my head low and out of his way." Workers, whether
they are in public or private practice, just can't work efficiently when
their attention is focused on looking for another job or avoiding their
boss.

Aguirre has engaged in unethical legal practices
that conflict with his role as city attorney and the role of his office.
Rather than represent and advise the mayor, city
council and city departments, he has constantly
accused them of wrongdoing, investigated them
,
called them names and generally butted heads with them wherever
and whenever possible.

He has also issued legal opinions contrary to the city's already-pled
litigation defenses being pursued by his own attorneys in the sewage
fee case and in the Mount Soledad cross controversy, and has
recently done a similar disservice to the city with his
condo-conversion opinion. That's not what I would call "representing
the client."

It's now been a year since Aguirre took office, yet I can't recall any
completed projects or new programs initiated by him that have made
San Diego a better city.


Recommendations for improvement, if ever they are made, are held
in abeyance until reports or investigations are complete. I've lost
count of the number of his investigations -- nevermind his
suggestions of what should be investigated like the alleged fraud that
he said last year may have unfairly kept the Cal Berkeley football team
out of a BCS bowl game.

Oh, and what happened to the investigations about the San Diego
Food Bank, sewage fees, gasoline price gouging, the NTC contract,
under-reporting of crime statistics, counting votes on election day,
and the Torrey Pines golf tee times? Aguirre is looking a lot like Don
Quixote fighting windmills with these incessant, never-completed
investigations.

Yet, you can add me to the majority of San Diegans who actually
believe that at least someone stepped forward to lead the city while
there was a power vacuum at City Hall.

However, there has been little serious discussion
about what the cost to the city has been, and will
be, in money, morals, reputation and values when
that leadership comes from bullying, threatening,
name-calling and untrustworthy, unethical
behavior. Do we want our elected officials to
behave in a way that we wouldn't tolerate in our
own children?

On whatever side you happen to fall (assuming there are only two)
about whether or not the city attorney should be setting policy for the
city, you should recognize that, at some point,
a train wreck is
bound to happen when our elected policy makers
cannot or will not ask their attorney for advice.

If they aren't talking to their attorney -- and trust me, they are not -- then
they either get no advice, or
they seek and get advice
from persons who are not accountable to the
electorate.

So, under the guise or mantra of "open and transparent government,"
the very people in the system who need to change the way they
operate are now seeking advice from unidentified people not
accountable to you and me. Why? Because their attorney constantly
threatens them with investigation, prosecution or lawsuits at every
turn.

It may be that the only people who will feel brave or comfortable
enough to step forward in the future to serve on the city council, in city
government, on boards and commissions, or in the city attorney's
office itself, are those people to whom Aguirre has granted immunity
from one of his investigations.

My advice to Mike is this: Before you launch another investigation and
hold another press conference,
do what ethical attorneys
do -- confer with your client.
Exhibit some leadership by
concluding your reports. Make recommendations for improvement.
Be respectful of those who are mentioned in your written documents.

Stop constantly hinting at culpability.
Use only proven
facts. Stop posturing.

Recognize that the only way you will be able to effect positive change
in the city is if city officials and employees trust your motives and the
way you approach issues. Only then will they willingly consult you.
People will never consult with you if they believe
they will become a source or subject for your next
day's press release or newspaper headline.
People
simply do not want to find their names in the newspaper or in one of
your so-called investigations.

Develop some positive ideas or programs that will improve
neighborhoods, provide better access to government and cut red tape
in the city bureaucracy, rather than constantly seek publicity by press
releases and press conferences. Maybe, just maybe, you could go
down in San Diego's history as someone who made a positive
change rather than someone who launched a thousand incomplete
investigations and really "shook things up at City Hall."

The collateral damage that will result if Aguirre
continues to operate as he has over the last year
will be devastating to the city in the long run
unless he changes course.

While his actions now might "feel good" and be
appealing to the general public, they have
consequences that will indeed be painful in the
years to come.

I hope I'm wrong.

Leslie E. Devaney is a partner at the law firm of Stutz Artiano Shinoff &
Holtz. She ran against Aguirre for city attorney in 2004 and lost by a
0.8 percent margin.
But Lesley Devaney doesn't think there
should be serious discussions about what
the cost to the city was, and will be, in
money, morals, reputation and values of the
secret pension deal.

Leslie Devaney's law firm went to court to get
a ruling that I could not accuse her law firm
of intimidation.
A train wreck did occur when the previous
city council asked the city attorney's office for
advice when Leslie Devaney was second in
command in that office.  The city may very
well end up declaring bankruptcy due to the
secret agreement to underfund the pension,
leaving the city over a billion dollars in debt
to the pension fund.  The SEC investigated
the dishonesty toward bond holders.  

Leslie Devaney thinks office holders should
not be accountable, but rather have the city
attorney help them avoid responsibility for
their actions.
This reminds me of Daniel Shinoff's actions
as lawyer for MiraCosta College.

union presidents' requests to use their
union salaries to calculate their City
pensions. Permitting union employees to
participate iii the City
pension raised tax questions. To address
these tax law questions, the City retained
attorney Michael Changaris to issue an
opinion.

'On that same day, former Assistant City
Attoiney Leslie Devaney left a phone
message seeking advice:

... A spiky bouquet – the Sterling Silver Tongue award – to the attorneys for seven fired Tri-City
executives who are suing four board members, Tri-City Medical Center and its current CEO
for illegal termination and defamation.

Without judging the merits of the case, one thing you have to admire about the lawsuit's
complaint, fashioned by the law firm of Stutz, Artiano, Shinoff & Holtz, is the way it focuses like
a laser on what it calls, over and over and over, the “Sterling Faction.”

The overriding theory of the lawsuit is that the chain of events that led to the firing of the seven
high-level executives, as well as the departure of former CEO Arthur Gonzalez via settlement,
was orchestrated exclusively by Kathleen Sterling, a maverick board member with a score of
scores to settle against the Tri-City executives and several hostile board members.

Here's an illustrative paragraph from the complaint that lays out the dynamic that the plaintiffs
hope will earn them millions of dollars in damages:

“The Healthcare Executives are informed and believe that as soon as elected (in November),
the Sterling Faction set out to exact revenge against the Healthcare Executives and then-CEO
Gonzalez who had worked for so many years to protect the District and the public from
Defendant Sterling's abuses and that the Sterling Faction set out to exact retribution for the
Healthcare Executives' perceived anti-union political beliefs. Even before the elections were
certified, the union-backed Sterling Faction began meeting as a group to plot the ouster . . . ”

In the plaintiffs' narrative, the other board members of the Sterling Faction – RoseMarie Reno,
Charlene Anderson and George Coulter – were mere pro-union stooges under Sterling's
decisive thumb.

By focusing the lawsuit on Sterling, the Exiled Seven's attorneys accomplish a couple of
things. They create a colorful villain with a well-documented history of odd behavior. Moreover,
they posit a highly personal motive for the firings – Sterling's burning desire for vengeance –
that dovetails with the allegedly self-interested agenda of the nurses union.

If a jury ever hears this mother of all termination cases – each plaintiff is asking for a
minimum of a million dollars, and that doesn't include punitive damages – Sterling will be the
alleged conspiracy's ringleader, the star of the show.

And the other defendants? They're just stooges, along for the ride.

City legal bills for fairground purchase mounting

Del Mar is projecting it will spend more than $200,000 on legal services on its
potential purchase of the Del Mar Fairgrounds by June 30, the end of its fiscal
year.

Del Mar reached a deal with the state last year to buy the venue for $120
million. Legislation authorizing the sale is currently pending. The purchase
would be financed through a $30 million upfront payment from a group of
horsemen, $45 million in bonds, and a $45 million loan from the state.

The city is using three legal firms to help with the sale, according to a city staff
report.

Del Mar is projecting it will pay its city attorney firm, Stutz, Artiano,
Shinoff & Holtz, $97,703 above what it already pays for regular
services by June 30.
The city has already spent an additional $44,411 in
legal fees connected with the fairgrounds sale to date. The firm charges $220
per hour for partners, and $205 an hour for associates.

The city also hired Nossaman LLP for its expertise on state government. Del
Mar projects paying that firm $60,000 by June 30.

Finally, Del Mar has also authorized $50,000 in work from its bond council
firm, Orrick, Herrington & Sutcliffe LLP, the maximum dollar amount currently
allowed. That limit, however, would be increased to $150,000 if the agreement
with the state is finalized. If bonds are actually issued, there will be no cap on
what the firm can be paid for its services. All expenses to Orrick, Herrington &
Sutcliffe LLP are payable through bond proceeds. The city staff report says
Del Mar would also be reimbursed for its current expenses to the firm through
the bonds if the sale goes through.

Del Mar and the state began negotiations for the 400-plus acre property in
summer 2009.
Murrieta enacts limiting measures, one may go
to court

Murrieta Measures C, D, and E have been a hotly debated topic amongst the
city and its residents since they were passed in November.

Measure C said elected city officials cannot serve more than two consecutive
four-year terms in office. Terms are said to be consecutive unless they are at
least four years apart.

The council passed an ordinance two weeks ago to implement Measures C
and D but they changed something residents didn’t like.

The ordinance stated that term limits would start this year. City Council
members voted into office last year would be eligible for another eight years
in office.

Measure C was on the last Tuesday’s agenda to the delight of voters. The
City Council retracted its earlier ordinance, and with a 4-0 vote, Kelly Bennett
being absent, the law is now officially in affect in line with its original text,
giving current elected council members the chance to only serve one more
term.

Measure D was also reconsidered. City Council members voted to be paid a
salary of 15 percent of the average family income.

The average annual household income in Murrieta is $97,200. Council
members would make no more than $14,580 a year.

General law mandates City Council member salaries based on a city’s
population.

Murrieta has a population just over 100,000 people. Under general law City
Council members in cities with a population of 75,000 to 150,000 people can
make up to $600 per month.

Council members can raise their salary up to 5 percent each year under
general law.

The measure changed the state law that governs their salary increases.
Voters must now approve them.

The measure also prohibits council members from having personal
benefits such as club memberships
, medical or life insurance, or
pensions.

Del Mar, Solana Beach sue fairgrounds

Del Mar and Solana Beach will team up to sue the Del Mar Fairgrounds over
the state-owned venue's recently approved expansion plan.

Del Mar City Attorney Leslie Devaney made the announcement Monday after
a lengthy closed-session meeting at Del Mar City Hall.

The fairgrounds released a draft environmental study of its master plan for
expansion in late 2009. The project, at least five years away due to a lack of
funding, called for exhibit halls featuring rooftop soccer fields, a hotel and
condominium complex, increased parking and improvements to the track and
other facilities.

Neighboring cities Del Mar and Solana Beach blasted the master plan's
environmental study, a more than 4,000 page document that both said
"woefully" failed to adequately analyze effects on traffic, noise, lighting and
city infrastructure. Solana Beach spent $75,000 on consultants to study the
document.

Despite the criticism, the fair board, comprised of governor-appointees,
certified a scaled-back version of the project April 18. The venue's governing
body voted to remove the hotel amid criticism about its location next to
sensitive coastal wetlands. The board also voted to hold public hearings to
help design the larger parts of the master plan.

"You've got to wonder what they're suing about," said Fairgrounds CEO Tim
Fennell, adding that he stands by the environmental report and its legal
defensibility.

Devaney said Del Mar and Solana Beach would enter a "joint representation
agreement" to move forward with litigation against the master plan.

Officials from Solana Beach and Del Mar have expressed skepticism at the
fair board's concessions, saying the management could still develop the
property to its liking, ignoring public comment.

Solana Beach City Manager David Ott said Monday that more information
would come out as the week moves on.

"I think it's safe to say we're coordinating," Ott said of the apparent
arrangement between the two cities.

The Del Mar fair board meets on Tuesday. The Solana Beach City Council
meets on Wednesday.

The impending litigation adds to what is already a tense relationship between
the Del Mar City Council and fairgrounds management.

Del Mar last year reached a deal with the state to buy the venue for $120
million, igniting intense opposition from the fair board. A bill authorizing that
sale has been introduced in the state Legislature.
Firm claims bias in stadium security selection

An unsuccessful bidder for the security contract at Qualcomm Stadium said Wednesday there were signs of favoritism in the
selection process.

A representative of the company StaffPro made the claim during a hearing to review its protest over the recommendation of Elite
Show Services for the contract.

The city’s multi-year pact with Elite was put on hold earlier this year because of the protest.

StaffPro contended that the stadium official in charge of the three-member committee evaluating the bids was bias, pointing to the
fact that Elite used him as a reference.

A StaffPro official said it was inappropriate for stadium general manager Michael McSweeney to be involved in the recommendation.

A city official countered that McSweeney “was the obvious person to be on this panel.”

“It was his stadium,” Deputy City Attorney Debra Bevier testified before the protest hearing panel made up of city officials.

StaffPro was represented by Leslie Devaney, the former chief deputy city attorney who was hired to challenge the bid selection.

“He was biased. He was in favor of Elite. He should not have been on that panel,” Devaney said of McSweeney.

McSweeney was a central focus of the hearing, even though he was not there.

Bevier said the stadium manager wanted to testify, but she decided against it. She said city officials would have been remiss if
McSweeney was not involved in evaluating the bids.

As for McSweeney being a reference for Elite, Bevier said StaffPro also could have sought him for a reference.

The four-hour hearing delved into StaffPro’s complaint filed earlier this year that Elite was unjustly recommended to provide security,
ushering and other services at Qualcomm Stadium.

No decision was made by the hearing panel. Instead, the testimony and evidence were taken under submission and a decision will
be forthcoming within 30 days.

Elite has held the stadium security contract since the 1990s.

In 2009, The San Diego Union-Tribune reported that city officials quietly approved a no-bid agreement for Elite to secure the stadium
through 2035. After that, the city arranged to put the contract out to bid.

Five other companies bid lower than the $19.97 an hour proposed by Elite, which nevertheless was recommended for the contract.

“It just didn’t seem right,” StaffPro owner Cory Meredith testified Wednesday. “It didn’t feel right. Something’s going on here that’s not
right.”

McSweeney has said previously that cost was not the only factor in choosing Elite. He said the company knows the stadium, works
well with San Diego police and that security concerns call for having a single company manage all events.

The deal in question is for a two-person crew to patrol the grounds 24 hours a day, but the agreement is far more lucrative than that.
Under city policy, tenants that rent the stadium or parking lot are required to hire the company that provides 24-hour security for ticket-
taking, usher and other services.

According to Meredith, that city policy is unusual and unnecessary — and worth $2 million or more a year.

it was just reported that AIG's CEO, Robert Benmosche, claimed that the anger over these executive
bonuses is "just as bad and just as wrong" as white vigilante mobs lynching African Americans in the
Deep South.

In an interview with the Wall Street Journal, Benmosche said that the uproar over bonuses "was intended to stir
public anger, to get everybody out there with their pitchforks and their hangman nooses, and all that — sort of
like what we did in the Deep South [decades ago]. And I think it was just as bad and just as wrong."2

It is simply outrageous for the CEO of a bailed-out company to take verbal criticism about the irresponsible use
of taxpayer dollars and equate it with the murderous violence meted out to African Americans in the South. We
cannot let Benmosche's remarks stand.

Benmosche has responded to concern over his remarks by saying in a prepared statement, "It was a poor
choice of words. I never meant to offend anyone by it." This statement falls far short of acknowledging the utter
astonishment and incredible offense his remarks have caused.3

Rep. Elijah E. Cummings called for Benmosche's resignation, stating, "As the leading critic of AIG's lavish
spending before and after its taxpayer-funded bailout — and as the son of sharecroppers who actually
experienced lynchings in their communities — I find it unbelievably appalling that Mr. Benmosche equates the
violent repression of the African American people with congressional efforts to prevent the waste of taxpayer
dollars."4

It was completely appropriate for Americans to criticize the company that received the biggest government
bailout in U.S. history when it turned around and gave millions of dollars just months later in bonuses to the
executives that presided over its near collapse.

It is beyond offensive for the CEO of AIG to compare that criticism to the white vigilante violence that terrorized
African Americans during one of the darkest chapters in American history.
